The Village of Bartlett (the "Village") Building Department (the "Building Department") and the Bartlett Fire Protection District (the "Fire Department") are hereby authorized to conduct annual inspections of properties described in section 9-12A-2 herein to be performed in accordance with the provisions of this Chapter 12A.

The following properties located within the corporate limits of the Village have been designated for annual inspections: (1) commercial and/or industrial properties located in the B-I, B-2, B-3, B-4, OR, P-I, I-1 or I-2 Districts, or within a PD Planned Development District that has been designated as office research, industrial, commercial and/or business, or within a PUD that contains industrial, commercial and/or business uses; and (2) the common areas of multi-family buildings located in the SR-5 or SR-6 Districts (including SR-5 PUD and SR-6 PUD Districts), or in a PD Planned Development District that has been designated as SR-5 or SR-6. A list of properties subject to the annual inspections is on file with the Building Department, and is updated from time to time by the Building Department.

The purpose of the annual inspection program is to:

Sprinkler plans are to be submitted to the Bartlett Building Department.

Add to IBC® 903.4.2 and IFC 903.4.2 to provide an outside visual/audio device over the fire department connection (red strobe light).

A. Add to IBC® 903.4.3 and IFC 903.4.3 in multiple story buildings, provide floor           control valves with water flow switches for each floor.

Add to IBC 903.6 and IFC 903.6 by each hydraulically calculated area on each drawing, provide a copy of the hydraulic name plate.

Delete IFC section 907.2 (and all related exceptions). Manual pulls stations and audio visual alarm devices and alarm indicating appliances shall be provided, seen and heard in all areas of every building. All sprinkled buildings shall be provided with audio/visual devices. This will provide full building notification.

Key boxes are required outside all front entrances and all sprinkler rooms for all buildings, except single-family homes, two-family dwellings and townhouses. Provide a key box on all existing buildings that are renovated or at change of occupancy.

Amend IFC section 508.5 to read the fire hydrant shall be located at a minimum of 40' from the building structure. Add IBC® 913: Fire hydrants shall be provided around the perimeter of the building in three hundred foot (300') increments. Also, a fire hydrant shall be located within one hundred feet (100') of the fire department connection on the fire protection water supply to the building.

Except for single-family homes, two-family dwellings and town homes, additions to existing buildings totaling one thousand five hundred (1,500) square feet or more, the existing building and addition, regardless of fire walls or fire barriers shall be sprinkled. In addition, fire alarm systems shall be installed.

All buildings are required to be equipped with heat and smoke detectors tied into the fire protection district's dispatch center via Keltron radio, except for single-family homes, two-family dwellings and townhouses.

All new uses and build-outs of existing uses shall be submitted to Bartlett Building Department and reviewed by the local Fire Protection District. The Building Department will require an approval letter from the fire district that the proposed plans have been reviewed and approved before permit is issued.

IBC 903.12 and IFC 903.12 Provide a minimum of a one hour separation of sprinkler valve room and/or fire pump room. All sprinkler control and fire pump rooms shall be accessible by a direct outside access door and accessible from the inside of the building with six inch letters identifying the room.

The fire hose valves system piping shall be:

All buildings of all use groups, other than one and two family dwellings, greater than 1500 square feet shall be protected with an automatic fire sprinkler system installed per NFPA 13. Provide all spec warehouse buildings (Use groups S or F) with a ceiling roof height of 25 feet or greater to be protected with an ESFR fire sprinkler system or a hydraulically calculated system for class IV commodities wit rack storage calculated to the greatest storage height. All sprinkler systems shall be electronically supervised by a fire alarm system.

All non-residential multiple tenant buildings, will be "ring by tenant" activated by the fire a fire sprinkler system flow switch for that space or automatic fire detection and shall include a weatherproof clear outside strobe over the entrance to each tenant space as directed by the fire department. All outside strobes shall be 75 candela minimum. Fire Department sprinkler connections shall be a four inch Stortz type quick release with a thirty degree downward elbow.

Fire sprinkler system inspectors test valves shall be accessible at all times and located no more than six feet above the finished floor. On multiple riser systems test valves shall be marked as to which riser and area it tests.

This ordinance shall be known as THE BARTLETT Fl RE PROTECTION DISTRICT FIRE CODE, herein after referred to as "This Code"

Subject to modifications hereinafter set forth, the following codes, regulations and records are hereby expressly incorporated in the Bartlett Fire Protection District Fire Code by this reference, and are adopted as THE BARTLETT FIRE PROTECTION DISTRICT FIRE CODE, pursuant to Section 50 ILCS220/.01 etseg. of the Municipal Adoption of Codes and Records Act, which authorizes municipalities to incorporate by reference the provisions of nationally recognized technical codes and records:

Except for the deletions, modifications, additions and amendments which follow, all provisions of the foregoing codes incorporated herein by reference are expressly made part of this Code just as if they were fully set forth herein. The following deletions as set forth and the deletions, modifications and provisions set forth in Chapter 1, shall supersede the requirements in the codes adopted in this Section 1.2.

All buildings in every fire area, except detached garages, shall be provided with complete sprinkler protection in accordance the requirements of applicable standards NFPA 13, NFPA 13R or NFPA 13D.

Fire Protection Systems: Automatic fire suppression systems shall be installed and maintained in full operating condition in all new construction for all buildings and structures containing any commercial, storage, industrial or institutional uses, and for all buildings and structures in which dwelling units are located except detached residential garages.

All commercial cooking systems shall be equipped with a U.L. 300 listed wet chemical kitchen hood extinguishing system in accordance with standards NFPA 17A (2002), NFPA 96 (2004)and International Mechanical Code.(2006)

Sprinkler plans with 10 heads or less shall be submitted to the Bartlett Fire Protection District Fire Prevention Bureau. Any sprinkler plans with greater than 10 heads shall be submitted to Fire Safety Consultants 847-697-1300. The Fire Protection District will require an approval letter from the District’s consultant stating that the review fees have been paid and the plans have been approved prior to any rough inspections.

Add to IBC/IFC 903.4.2 on commercial and multi-family tenant residential buildings exceeding eight units; provide an outside weather proof visual device over the fire department sprinkler connection. It shall be a red strobe. Also provide a white strobe visual device at the front entrance of each building.

Add new IBC/IFC section 903.6 Provide a minimum of 10% or 10 psi safety factor in the fire protection system hydraulic calculation. The system demand shall be 10% below the seasonal low water flow test supply.

Add to IBC/IFC 903.4.3 in multiple story buildings; provide floor control valves with water flow switches for each floor.

In addition, the appendices of all NFPA standards are to be considered as part of each standard and are considered “shall” requirements, not “should” information.

Provide an OS&Y control valve on all fire pump test headers.

Provide an outside test header on all fire pump installations.

Inspectors Test Valves shall be located in a remote location approved by the Fire Protection District.

Additions to existing commercial buildings and structures and commercial buildings and structures being renovated shall be sprinkled.

Sprinkler Building Exception: In multiple tenant strip mall buildings, provide a full detection system zoned per tenant space with a white strobe outside each tenant space.

Audio/Visual notification appliances shall be installed in all rooms of all commercial buildings with the exception of closets and storage rooms over 100 sq. feet and shall operate upon activation of the fire alarm system or water flow of the sprinkler system.

Add section 903.3.7. The fire department connection shall be a 4”quick connect (Storz) with a 30 degree downward elbow as approved by the Fire Protection District.

Sprinkler Valve and Fire Pump Rooms: IBC/IFC 903.12. All fire protection systems shall be accessible directly by both an outside access door and inside access door.

All fire protection systems shall be located in a separate room with a minimum of a 1 hour fire rating.

Each door shall be provided with the rooms name with a minimum of 4 inch letters on interior doors and 6 inch letters on exterior doors.

Fire alarm panels shall be located in the sprinkler control room.

All fire hose valves (1 ½” and 2 ½”) shall be of the field
Adjustable type or as approved by the Fire Protection District.

In all warehouses and storage areas 20,000 square feet or greater where storage exceeds 12 feet high, provide inside 2 ½” NST fire hose valves with 2 ½” to 1 ½” NST reducer connection. Locate valves at each door entrance to the warehouse and/or storage area. Provide additional 2 ½” fire hose valves so that no portion of the warehouse and/or storage area is more than 120’ maximum travel distance to a fire hose valve. Show the location of all obstructions and/or racks on the drawing.

A separate riser piping system.

Hydraulically calculated for a minimum of 250 gpm at 65 psi to the most hydraulically remote fire hose valve.

The 2½” valves shall be supplied by a minimum of 4” with 2 ½” drops to each valve.

Where systems pressures exceed 100 psi provide Potter reduced pressure field adjustable type valves

IBC/IFC 905.3 building height: standpipes are required in all buildings, over two stories high or two stories below grade except single family homes and two family homes and townhouses.

Exception: Exceptions 2 and 3 shall be revised to provide that: Class I automatic dry standpipes shall be required in all open and enclosed parking garages.

Fire Extinguishers: Add IBC new section 906.3 Fire extinguishers shall be a minimum of 10 pounds and shall be of the rechargeable type.

Fire extinguishers shall be installed in all buildings per NFPA 10 latest edition requirements.

Amend 906.1-a wet chemical K type fire extinguisher shall be placed within 10 feet of commercial cooking equipment or at a location approved by the fire official.

A fire alarm system with combination smoke and heat detectors and audio/visual devices shall be installed in all remodeled buildings not equipped with a sprinkler system shall be monitored by the Fire Protection District’s dispatch center via dedicated telephone line or radio frequency.

A fire alarm system with combination smoke and heat detectors are required in all common areas of multi-family unit dwellings exceeding 4 units and the fire alarm system shall be monitored by the Fire Protection District’s dispatch center via dedicated telephone line or radio frequency.

Smoke detectors shall be installed in each room of all commercial buildings regardless of being equipped with sprinkler system with the exception warehouse or production areas of occupancy classification S and F.

Fire alarm panels shall be located in the sprinkler equipment/pump room or at a location approved by the Fire Protection District.

Four (4) sets of fire alarm system plans shall be submitted to the Bartlett Fire Protection District for review by the District’s consultant. Fees for plan review shall be the responsibility of the contractor submitting such plans. All plans shall be signed and stamped by a licensed engineer.

Fire alarm panels shall be of the addressable type.

Fire Alarm systems shall include sixty (60) hours of battery back up.

Smoke & Heat Vents: Revise IBC/IFC section 910.2.1 as follows: Use groups F and S. Provide smoke and heat vents in all F and S use groups having more than 20,000 square feet.

Manual pull stations with audio/visual devices shall be provided in all buildings and use groups except single family homes and townhouses with 8 units or less.

Key Boxes: Add IBC/IFC section 903.9. Key boxes are required outside all sprinkler/fire pump rooms for all buildings or as designated by the fire official.

Installation of a key box shall be made on all existing buildings that are renovated or remodeled, or when a change of ownership or occupancy occurs and installation of a key box shall be made on all existing multi-family residential buildings exceeding 8 dwelling units.

Dry Hydrants for Rural Water Supply: NFPA 24 where applicable.

Gravity & Pressure Tanks: NFPA 22, Standard for Water Tanks for Private Fire Protection.

Contractors/Building Owners or Occupants shall request fire inspections by notice to the Fire Protection District by telephone or in writing at least 48 hours in advance for the inspection of 10 alarm appliances or less or 10 sprinkler heads or less.
Contractors/Building Owners shall contact Fire Safety Consultants at 847-697-1300 for sprinkler or fire alarm systems exceeding 10 appliances or sprinkler heads. Required inspections are as follows:

Sprinkler Systems, hydrostatic, flow tests, open ceiling.

Fire Alarm Systems

Fire Pump Test

Hood Extinguishing Systems

New Occupancy after build out

Change of Occupancy

Change of Ownership

Final Construction for Occupancy

Fire/Life Safety Inspections may be by conducted at any time by Fire Protection District personnel without notice during normal business hours.

Interpretation: Wherever in any Code it is provided that installation, work, repairs or systems must be installed or repaired subject to the approval of or subject to the direction of the Fire Chief, Assistant Fire Chief, Fire Inspector or any other official of the Bartlett Fire Protection District, the approval or direction shall be construed to mean such officer’s discretion is limited to determine whether the rules and standards established by this Code have been complied with; and no such provision shall be construed as giving any officer discretionary powers as to what such regulations or standards shall be, or discretion to require conditions not prescribed by this code or other ordinance or to enforce this code in an arbitrary or discriminatory manner.

STOP ORDER: Whenever any work is being done in violation of the provisions of this Code, or in variance with the terms of any permit issued for such work, the Fire Chief, Assistant Fire Chief or the Fire Inspector may order all work or installation made in violation of this Code corrected. Such stop order, if oral shall be followed by a written stop order within forty-eight (48) hours unless the following day is a Saturday, Sunday or holiday, in which event, said written stop order shall issue within twenty-four (24) hours of the next succeeding business day.

It shall be unlawful to do or perform any work in violation of a stop order, except as may be necessary to prevent immediate injury to person(s) or damage to property.

The Fire Chief or the Assistant Fire Chief may in their discretion remove, lift or rescind any such stop work order.

Appeals: Appeals must be submitted in writing to the President of the Board of Trustees of the Bartlett Fire Protection District within thirty (30) days after the Fire Chief or other fire official issues the written ruling from which the appeal is taken. The Board President shall hear and rule upon appeals from the decisions of the Fire Chief with regard to the interpretation and application of the provisions of this Code, with respect to all maters in which he/she is given discretionary powers. In the event any permit is denied to any applicant, the Board President shall hear and rule upon the appeal from the decision denying such permit. The applicant shall be given the opportunity to present evidence that the Fire Chief or other fire official has unreasonably denied the permit requested, or has unreasonably stopped the appellant’s work or has otherwise acted unreasonably in the enforcement of this code.

Penalties: Any person found guilty of violating, disobeying, omitting, neglecting or refusing to comply with any of the provisions of this Code shall be fined not less than fifty and 00/100 dollars ($50.00), nor more than five hundred and 00/100 dollars ($750.00) for each offense. A separate and distinct offense shall be deemed committed each day in which a violation occurs or continues.

Other Remedies: Nothing in this ordinance shall be construed as limiting any judicial remedies that the Fire Protection District may have, at law or in equity for enforcement of this ordinance, including, but limited to, all rights and remedies pursuant to Sections 11-31-1 and 11-31-2 of the Illinois Municipal Code (65ILCS5/11-31-1; 65ILCS5/11-31-2). In the event the Fire Chief, Assistant Fire Chief or Fire Inspector reasonably determines that (1) the condition of a building or structure poses a risk of immediate harm to any person and/or property, or (2) that the delay in complying with any notice or other provision of this Code or any other law or ordinance and/or contractor would unreasonably endanger the safety or health of any person(s) and property, the attorney for the Fire Protection District shall apply to a court of competent jurisdiction for an issuance of temporary restraining order, preliminary injunction and/or permanent injunction requiring compliance as authorized by statute.

Any ordinance or resolution in conflict with the provisions of this ordinance is hereby repealed solely to the extent of such conflict.

If any section, paragraph or provisions of this ordinance shall be held invalid or unenforceable for any reason by a court of competent jurisdiction, such invalidity or unenforceability shall not affect any of the remaining provisions of this ordinance nor held invalid or unenforceable.

That the Secretary of the District is hereby directed to publish this Ordinance in its entirety at least once in a newspaper published or with a general circulation within the District. Publication shall take place at least ten (10) days prior to the implementation of this Ordinance. The provisions of this Ordinance shall be in force and effect ten (10) days after passage, approval and publication as provided by law.
